Terms and Conditions

 

Terminology:

  • Fortuna Spinoza Bed & Breakfast Monnickendam, Fortuna Spinoza, B&B: Terms referring to Fortuna Spinoza Bed and Breakfast in Monnickendam.
  • Guest: A person who has made a reservation and is staying at the B&B, duly registered as such.
  • Main Guest: The person who made the reservation at the B&B. The main guest must be over 18 years old and is responsible for their co-guests.
  • Manager: The person who manages the B&B, either as the owner or on behalf of the owner.
  • Third Parties: Any legal entity that is not a guest, manager, or owner.
  • Reservation: Confirmation of a reservation request by Fortuna Spinoza Monnickendam.
  • Cancellation: The revocation or dissolution of the final reservation within the applicable period or a no-show at the time of the reservation.

 

1. Fortuna Spinoza Bed & Breakfast Monnickendam

  • 1.1: The B&B is described on the website www.fortunaspinoza.nl. While the website is carefully composed, differences may exist between the presented text/photos on the website and the current situation at the B&B during the guest(s) visit. No rights can be derived by guests from such differences.
  • 1.2: The minimum stay at Fortuna Spinoza is one night. Different minimum stays may apply during holiday periods, weekends, and/or summer months.
  • 1.3: The B&B is accessible 24/7, with rooms having lockable doors.
  • 1.4: Quiet hours are from 22:00 to 07:00.
  • 1.5: Smoking is not allowed indoors in rooms or common areas. Smoking is allowed outdoors.
  • 1.6: Guests’ pets are not allowed unless otherwise agreed upon between the guest and manager.
  • 1.7: Rooms are suitable for two people unless indicated otherwise in the reservation.
  • 1.8: Check-in from 15:00-20:00, check-out by 11:00. Late check-in is possible through a code lock.
  • 1.9: Fortuna Spinoza is less suitable for children.
  • 1.10: Organizing parties or causing noise disturbance is not allowed.
  • 1.11: Guests can park their cars on the street. Parking is at their own risk.
  • 1.12: Guests must have a permanent residence.
  • 1.13: Guests must follow the instructions of the managers.
  • 1.14: Managers can deny access to Fortuna Spinoza and/or refuse service immediately and without refund for violation of terms and conditions, household regulations, or inappropriate behavior.
  • 1.15: Guests must adhere to the household regulations provided online during reservation.
  • 1.16: Fortuna Spinoza is registered with the Chamber of Commerce under number 82806128.

 

2. Rates

  • 2.1: Rates include gas, water, electricity, and heating. Rates include VAT and exclude tourist tax. Rates exclude the use of drinks/snacks from the minibar.
  • 2.2: Rates exclude cancellation and/or travel insurance costs and/or other fees.
  • 2.3: B&B rates are always non-binding and subject to interim changes.
  • 2.4: All mentions on the B&B website (www.fortunaspinoza.nl) are assumed to be in good faith and are always subject to interim adjustments. The B&B is not bound by obvious errors on its website.

3. Reservation and Payment

  • 3.1: Reservations can be made online via www.fortunaspinoza.nl, Booking.com, Airbnb, bedandbreakfast.eu, www.bedandbreakfast.nl, or by phone at +31(0)652285112.
  • 3.2: The reservation is only confirmed after Fortuna Spinoza confirms the reservation request.
  • 3.3: Reservations must be paid in advance to Fortuna Spinoza unless otherwise agreed with the guest.
  • 3.4: The deposit or total stay costs must be transferred to: Fortuna Spinoza ASN Bank The Hague IBAN: NL18ASNB8821090531 BIC: ASNB NL21
  • 3.5: Payment of the (remaining) amount must be made before checking out at the B&B. Payment can be made in cash, by PIN, or by credit card.

 

4.0 Cancellation

  • 4.1: Cancellation is free up to 7 days prior to the arrival date. For example, cancel for free on June 24 for an arrival on July 1.
  • 4.2: In case of cancellation within 7 days before the arrival date, 50% of the reservation rate will be charged. Cancellation costs exclude breakfast and tourist tax.
  • 4.3: In case of cancellation from 3 days before the arrival date, 100% of the reservation rate will be charged. Cancellation costs exclude tourist tax.
  • 4.4: Cancelling after arrival or early departure during the stay will result in charging the entire stay period (confirmed total travel cost).
  • 4.5: Cancellations can be communicated via email (info@fortunaspinoza) or phone (+31(0)652285112).
  • 4.6: Fortuna Spinoza reserves the right to cancel the final reservation more than 2 days before the arrival date without providing reasons. Prepaid deposits will be refunded to the main guest without charges.

 

5.0 Damage

  • 5.1: Guests must behave appropriately and use the B&B in accordance with reasonable instructions provided by the B&B or the owner/manager.
  • 5.2: The main guest is legally responsible for any damage caused by them or their co-guests to the B&B or its contents.
  • 5.3: In case of damage (damage, loss, disappearance, and/or theft), the guest must immediately report it to the owner or manager. Repair and/or replacement costs must be reimbursed by the guest immediately upon the owner/manager’s first request.
  • 5.4: If keys to the B&B are lost or not returned, all resulting costs will be charged to the main guest. The main guest agrees to pay this within 14 days of receiving the detailed invoice.
  • 5.5: If keys are not returned during check-out, the main guest is obligated to send the keys by registered mail to the B&B owner within 2 working days.

 

6.0 Complaints

  • 6.1: Guests always have the right to submit their grievances through a complaint to the B&B. The B&B must handle complaints promptly and adequately, ensuring that the complaint is dealt with in accordance with standards of reasonableness and fairness.

 

7.0 Force Majeure

  • 7.1: In case of force majeure, both permanent and temporary, the B&B is entitled to entirely or partially terminate the agreement or temporarily suspend it without the guest being able to claim performance and/or compensation. Force majeure includes, among other things, war danger, war, revolt, strikes, boycotts, disruptions in the power circuit, in traffic or transport, measures by the authorities, scarcity of raw materials, natural disasters, and all other circumstances, extraordinary weather conditions, death of owners or close family members, etc., under which the B&B cannot reasonably and fairly be expected to fulfill the agreement in whole or in part.

 

8.0 Liability

    • 8.1: The B&B cannot be held liable for damage suffered by the guest or third parties due to the stay in the accommodation; the guest indemnifies the B&B against claims in this regard. The B&B is not liable for disruptions in and around the accommodation such as disruptions and failures of electricity and water supplies and technical installations, not or untimely announced construction and/or roadworks in the vicinity of the B&B.
    • 8.2: The B&B can only be held liable for damage due to gross negligence or negligence on the part of the B&B.
    • 8.3: Without prejudice to the provisions of 8.1 and 8.2, the liability of the B&B, if and insofar as the B&B is held liable in law for any reason in connection with the user agreement, is always limited to direct damage, and any form of consequential damage is excluded. The liability of the B&B is furthermore always limited to the maximum amount that the insurer of the B&B will pay in the relevant case.
    • 8.4: The B&B accepts no liability for injury to persons and/or damage, loss, or theft of property of the users.

10 Conclusion

  • 10.1: Insofar as not otherwise determined by rules of international private law, exclusively Dutch law applies to these conditions. Non-Dutch-speaking guests are deemed to agree with the terms and conditions set forth in Dutch.
  • 10.2: All disputes arising from the user agreement or these conditions will be settled in the first instance by the competent court in the Netherlands, insofar as the rules of international private law do not determine otherwise.
  • 10.3: None of the parties can transfer its rights and obligations to third parties unless otherwise stipulated in these conditions.
  • 10.4: If and to the extent that any provision in the user agreement and these conditions should be null and void, the remaining conditions remain in force, and the null and void article is deemed to be converted in accordance with the apparent intentions of the parties.
